During the annual charges submission period (March each year) consent holders are able to apply for a waiver up to the maximum value of $1000 per annum of annual charges. The charges include administration, functions, powers and duties fees and any associated monitoring and supervision costs.
When to apply for a waiver
The consent holder is required to write to the Group Manager Customer Service and Support in March of each year to confirm their organisation's eligibility.
Applications for waivers outside this period can be made in writing to the General Manager Regulatory Services.
Criteria for fees being waived
The circumstances of the specific case will be examined in detail and any decision will be based on the following criteria:
- The consent holder must be a non-profit organisation, and
- The consent holder must clearly have no commercial way of raising revenue from the relevant consent, and
- The consent holder (or the purpose of the consent) must deliver a service(s) or outcome(s) that are relevant and consistent with the functions or values of the ARC, and
- The consent holder has continued to demonstrate compliance with the conditions of the relevant resource consent.
- In the case of coastal consents for seawalls, where the consent holder can prove to the satisfaction of the Chief Executive Officer that there is a significant environmental or community benefit by demonstrating
- environmental enhancement, including erosion protection, and
- and unfettered public access and use, and
- retention of the natural look of the coastline.
Requirements for consent holders to keep the waiver
If an application for a waiver is granted, there will be a requirement for the consent holder to make an annual declaration of continued compliance with the waiver criteria.
Where the consent is found to be not in compliance with its conditions of consent, the consent holder will be liable for the ongoing actual and reasonable costs of monitoring and supervision.
Reapplying for a waiver after remedying compliance issues
When the compliance issue has been remedied and monitoring has been undertaken by an ARC compliance officer, the consent holder may apply for a waiver of fees.
