Proposed Private Change 11, Proposed Change 12 and Variation 2 - Takanini

The Auckland Regional Council publicly notified, in October 2007, the following proposed changes to the Auckland Regional Policy Statement (ARPS) and variation to the Proposed Regional Plan: Air, Land and Water (PARP: ALW):

  • ARPS: Proposed Private Change 11: Extension to the Metropolitan Urban Limits at  Takanini, Takanini Structure Plan Area 2A.
  • ARPS: Proposed Change 12: Extension to the Metropolitan Urban Limits at Takanini,  Takanini Structure Plan Area Part 2B and 2C.
  • PARP ALW: Proposed Variation 2: Extension to the Urban Air Quality Management Areas, Takanini Structure Plan Areas 2A, Part 2B and 2C.

Hearings on these proposals have been held and the decisions of the Auckland Regional Council have now been released. Five appeals have been lodged with the Environment Court (see link below) in response to the ARC’s decisions on Proposed ARPS Private Change 11, Change 12 and Variation 2 to the PARP: ALW.

What is the expected timeframe for Proposed ARPS Private Change 11, Proposed ARPS Change 12 and Proposed Variation 2 to the PARP: ALW?

  • Proposed ARPS Private Change 11, Proposed Change 12 and Variation 2 to the PARP: ALW were notified on 17 October 2007
  • The closing date for submissions was 23 November 2007
  • Notification for further submissions was 13 February 2008
  • The closing date for further submissions was 20 March 2008
  • The submissions and further submissions were heard by the Regional Strategy and Planning (RSP) Subcommittee on the 26, 27 August 2008 and the 12th March 2009.
  • The recommendations of the RSP Subcommittee were adopted by the RSP Committee (June 3, 2009) and then the Council (June 29, 2009).
  • The decisions of the Council on Proposed ARPS Private Change 11, ARPS Change 12 and Variation 2 to the PARP: ALW were publicly notified on 1 July 2009.
  • Following the release of the decisions there is a statutory period of 30 working days during which appeals may be lodged.
  • Once any appeals have been resolved, Proposed ARPS Private Change 11, Proposed Change 12 and Variation 2 to the PARP: ALW will then be made operative by public notice.

Background to Auckland Regional Policy Statement: Proposed Private Change 11 - Extension to the Metropolitan Urban Limits, Takanini Structure Plan Area 2A

Pursuant to the First Schedule, Clause 25 (2) (b) of the Resource Management Act 1991, the Auckland Regional Council has resolved to accept that part of the Metropolitan Urban Limit request involving Area 2A of the Takanini Structure Plan. Part of Area 2A is affected by air noise contours generated by Ardmore Aerodrome and therefore subject to Proposed Plan Change 6 and Variation 1 of the Operative Papakura District Plan - Ardmore Aerodrome Noise Land Use Planning. This Plan Change and Variation are yet to be resolved. The area of land involved is approximately 50 hectares.

Proposed ARPS Private Change 11 will involve an amendment to Map Series 1: Sheet 20 of the Auckland Regional Policy Statement.

Background to Auckland Regional Policy Statement: Proposed Change 12 - Extension to the Metropolitan Urban Limits, Takanini Structure Plan Area Part 2B and 2C

Pursuant to the First Schedule, Clause 25 (2) (a) of the Resource Management Act 1991, the Auckland Regional Council has resolved to adopt that part of the Metropolitan Urban Limit request involving Areas Part 2B and 2C of the Takanini Structure Plan. The area of land involved is approximately 50 hectares.

Proposed ARPS Change 12 will involve an amendment to Map Series 1: Sheets 20 and 21 of the Auckland Regional Policy Statement.

When were the decisions notified?

  • The recommendations of the RSP Subcommittee were endorsed by the Council at its meeting on 29 June 2009. Public notice of the decisions was made on 1 July 2009.

The hearing decisions

In summary, the Council has adopted the following recommendations of the RSP Subcommittee, in respect to Proposed ARPS Changes 11 & 12 and Variation 2 to the PARP: ALW:

Area 2A and Part 2B of the Takanini Structure Plan

  • To reject the extension of the MUL to Area 2A of the Takanini Structure Plan (ARPS Change 11). The RSP Subcommittee has made this decision because of potential reverse sensitivity effects in relation to Ardmore Aerodrome; the proposed land use mix; and the lack of certainty around the management of storm water discharges from the proposed development.
  • To reject the extension of the MUL to Area Part 2B of the Takanini Structure Plan (part ARPS Change 12) because of the lack of certainty around the management of storm water discharges from the proposed development.
  • Under the PARP: ALW, an UAQMA can only be extended where there is a corresponding MUL extension. Because the RSP Subcommittee has decided to reject the MUL extension for Area 2A and Part 2B, the extension of the UAQMA for these areas has also been rejected.

Area 2C of the Takanini Structure Plan

  • To accept the extension of the MUL to Area 2C of the Takanini Structure Plan. The RSP Subcommittee has made this decision because the proposal is consistent with Part II of the RMA 1991; and meets the relevant objectives and policies of the Operative Auckland Regional Policy Statement and Proposed Change 6 to the Auckland Regional Policy Statement.
  • To accept the extension of the UAQMA for Area 2C. This extension has been accepted by the RSP Subcommittee because of the corresponding decision to extend the MUL for this area.

Appeals received to Proposed ARPS Private Change 11, Change 12, Variation 2 to the PARP: ALW

Five appeals were lodged with the Environment Court, in relation to the ARC decisions on Proposed ARPS Private Change 11, Change 12, Variation 2 to the PARP: ALW.

When will Proposed Private Change 11, Proposed Change 12 and Proposed Variation 2 become operative?

Resolution of  those matters raised in the appeals received will be by Environment Court consent order (where agreement is reached without the need for a court hearing) or through the Environment Court decision where a hearing is required. The amended ARPS Changes 11, 12 and Variation 2 to the PARP: ALW would then be made operative by public notice from the Council.
