Introduction

The Auckland Regional Council (ARC) is required by the Resource Management Act 1991 (RMA) to provide for the management of the region's natural resources via the consideration, granting and administration of permits, known as resource consents. These consents authorise and control a wide variety of activities that have the potential to adversely impact the region's environment.

Purpose of fees and charges

The RMA provides the ARC with a mechanism for funding both the provision of this consenting function, any on-going monitoring requirements associated with the exercise of the consents and contribution towards research, educational and advisory programmes

In order to achieve a fair and equitable sharing of the financial cost of this function the ARC has evaluated its functions and decided what proportion of each project and consent related activity should be recovered

  • directly from individuals (either holders of resource consents, consent applicants or people causing environmental degradation),
    and
  • what should be funded by the community at large through general rates.

How the fees and charges are set

These funding decisions are made in accordance with section 36 of the RMA, and are set out in the Revenue and Financing Policy section of the Auckland Regional Council Long Term Council Community Plan 2009-2019.

Types of resource consent charges

There are currently four types of charges, each with a different purpose.

  • Consent applications
  • Administration
  • Monitoring and supervision
  • Functions, powers and duties

Consent application charges

Consent application charges cover the full actual and reasonable costs of Council receiving and processing resource consent applications.

Administration charges

From the 2009-2010 year this fee has been discontinued.

Monitoring and supervision charges

The Monitoring and Supervision charge (MS) covers the cost of undertaking compliance monitoring inspections, reporting and administration associated with ensuring activities are carried out in accordance with consent conditions. This charge varies between consents

Functions, powers and duties

To cover consent holder contributions to Council's State of the Environment monitoring programmes, environmental research and investigations, educational and advisory programmes as provided for under section 35 RMA. These charges also vary between consent activity types.
