These terms of use apply to all users of the "Geographic Information & Mapping" service or any part of it (Service). By using the Service you will be deemed to have agreed to these terms of use without qualification. If you do not agree to be bound by these terms of use, please do not use the Service.

Access
You understand that the Auckland Regional Council (ARC) may for security and technical reasons at any time in its sole discretion and without prior notice to you, prohibit or restrict your access to the Service .

Information
ARC does not give any warranty as to the availability, accuracy, completeness, currency or reliability of the information or maps made available via the Service and expressly disclaims (to the maximum extent permitted by law) all liability for any damage or loss resulting from your use of, or reliance on the Service or the information or maps provided through them.

No Reliance
The maps provided through the Service have not been prepared with any specific purpose in mind. You understand that ARC does not give any advice or offer any opinion with regard to the accuracy, currency, reliability or suitability of any particular map for any particular purpose or in respect of any course of action taken in reliance upon any map. The availability of information and maps through the Service does not constitute a recommendation by ARC to enter into any transaction or follow any course of action. Any decision that you make after using the Service must be based solely on your own evaluation of the information available to you, your circumstances and objectives. ARC recommends that you independently verify the accuracy, currency, reliability or suitability of any map or information made available via the Service and upon which you intend to rely.

Personal Use
The Service is intended for your personal use only. You must not use the Service in connection with the carrying on of any business or for any commercial purpose.

Intellectual Property
You acknowledge that ARC is the proprietor or the authorised user of the copyright, trade marks and all other intellectual property rights (IP Rights) in the maps, information, software, text, graphics and other material (Content) displayed or available through the Service. Unauthorised use of the Content is strictly prohibited and may infringe the IP Rights in the Content.

Subject to these terms of use, ARC grants to you a non-exclusive and non-transferable single user licence to use the Content for your own private and non-commercial purposes. No content may be reproduced, published or transmitted in any manner without the prior written consent of ARC. You agree to reproduce on any copy of a map, or other information made available to you via the Service, all copyright notices associated with such information or maps.

The Auckland Regional Council acknowledges the use of IP from Environmental Systems Research Institute (ESRI) and Explorer Graphics Ltd (EGL) in the development of the "Spatial Information Portal" service.

Technical Difficulties
You acknowledge that your use of the Service may be subject to interruption or delay. Due to the nature of the internet, ARC does not make any warranty that the Service, or any map or information make available via it, will be error free, without interruption or delay or free from defects in design or engineering.

Liability
To the maximum extent permitted by law, you specifically agree to indemnify and hold ARC harmless from any and all claims relating to your use of the Service or use of them by any person on your behalf.

Severability
The illegality, invalidity or unenforceability of any part of the terms of use will not affect the legality, validity or enforceability of the remainder.

Variations
ARC may vary these terms of use from time to time. You will be notified of any variation. By continuing to use the Service after you have been notified of a variation you will be deemed to have agreed to the varied terms of use.

Termination
ARC may immediately terminate this agreement without liability if it reasonably believes you are in breach of these terms of use or wishes to withdraw the Service.

Law
These terms of use and your use of the Service will be governed by and construed in accordance with the laws of New Zealand and you submit to the jurisdiction of the New Zealand Courts.
