Variations and Plan Changes

The following is an overview of proposed variations that were notified prior to October 2010, when the plan was referred to as the Proposed Auckland Regional Plan: Air, Land and Water (PARP: ALW).  This is the terminology used below.  Since the Plan was made operative in part, two proposed changes have been notified to the Plan (now referred to as the Auckland Council Regional Plan: Air, Land and Water (2012)).

Variation 1:  Stormwater and wastewater network discharges [amendments to PARP: ALW and Auckland Regional Plan: Coastal]

Variation 1 to the PARP: ALW proposed amendments to Chapter 5 of the PARP: ALW and Chapter 10 and Chapter 20 of the Auckland Regional Plan: Coastal in order to align the stormwater and wastewater network discharge provisions of the Coastal Plan with those of the PARP: ALW. Variation 1 was notified in June 2002 and was incorporated into the Decisions Version of the PARP: ALW in 2005. The Council is involved in continuing negotiations on these Coastal Plan provisions.

Variation 2: Extension to the Urban Air Quality Management Areas (Takanini)

Variation 2 to the PARP: ALW: Extension to the Urban Air Quality Management Areas, Takanini became operative on 19th July 2010. It amends the PARP: ALW by extending the Urban Air Quality Management Areas in parts of Takanini.

Proposed Variation 3: Extension to the Urban Air Quality Management Areas and Industrial Air Quality Management Areas, Takanini Structure Plan Area 6A and 6B

Papakura District Council lodged an application with the Auckland Regional Council to extend the Metropolitan Urban Limits (MUL) at Takanini, notified on 9 December 2009 as Proposed Private Change 14 to the ARPS. This extension will incorporate Area 6A and 6B of the Takanini Structure Plan.

Area 6A and 6B of the Takanini Structure Plan are currently within Rural Air Quality Management Areas under the PARP: ALW. In the event that the MUL extension is confirmed, a variation will be required to this Plan so that two different air quality management areas (urban and industrial) can be applied to this site. These different air quality management areas reflect the proposed land use mix and district plan zoning. Proposed Variation 3 to the PARP: ALW has therefore been prepared to reflect the proposed extension to the MUL.

A decision on Proposed Private Change 14 to the ARPS and Proposed Variation 3 to the PARP: ALW and Proposed Change 15 to the Auckland Council District Plan (Papakura Section) was notified on 28 March 2012.

Proposed Variation 4: Extension to the Urban Air Quality Management Areas, Hobsonville and Massey North

The Auckland Regional Council publicly notified Proposed Variation 4: Extension to the Urban Air Quality Management Areas, Hobsonville and Massey North on 28 April 2010.  It amends the PARP: ALW by extending the Urban Air Quality Management Areas in parts of Hobsonville and Massey North. Hearings were held on 15 and 22 July 2010 and decisions were notified on 16 October 2010.  The decision approved the variation and amended the maps to extend the Urban Air Quality Management Area.

Proposed Variation 5: Extension to the Urban Air Quality Management Areas for the Hibiscus Coast Gateway.

Rodney District Council lodged an application with the Auckland Regional Council to extend the Metropolitan Urban Limits to include  95ha of additional urban land for the Hibiscus Coast Gateway.  This was notified as Proposed Private Change 15 to the ARPS on 24 June 2010.

The Hibiscus Coast Gateway area is currently within a Rural Air Quality Management Area under the Proposed Auckland Regional Plan: Air, Land and Water. In the event that the MUL extension is confirmed, a variation will be required to this Plan so that the urban air quality management can be applied to this area.  Proposed Variation 5 to the PARP: ALW has therefore been prepared to reflect the proposed extension to the MUL.

Proposed Variation 5 to the PARP: ALW will involve an amendment to Map Series 1 – Maps 16 and 20 and Map Series 1A - Maps 23 and 116 of the Proposed Auckland Regional Plan: Air, Land and Water.

Proposed Variation 6 Extension to the Urban Air Quality Management Areas for additional industrial land ‘Silverdale Industrial’

Rodney District Council lodged an application with the Auckland Regional Council to extend the Metropolitan Urban Limits to include approximately 8ha additional industrial land at Silverdale. This was notified as Proposed Private Change 16 to the ARPS on 24 June 2010.

The ‘Silverdale Industrial’ area is currently within a Rural Air Quality Management Area under the Proposed Auckland Regional Plan: Air, Land and Water. In the event that Auckland Regional Policy Statement Proposed Private Change 16 MUL extension is confirmed, a variation will be required to this Plan so that the urban air quality management can be applied to this area.  Proposed Variation 6 to the PARP: ALW has therefore been prepared to reflect the proposed extension to the MUL.

Proposed Variation 6 to the PARP: ALW will involve an amendment to Map Series 1 – Maps 16 and 20 and Map Series 1A - Maps 23 and 116 of the Proposed Auckland Regional Plan: Air, Land and Water.

Proposed Variation 7: Extension to the Urban Air Quality Management Areas, west of Hatfields beach.

Variation 7 to the PARP: ALW: Extension to the Urban Air Quality Management Areas, west of Hatfields Beach, became operative on 17 November 2011. It amends the PARP: ALW by extending the urban air quality management area west of Hatfields Beach.

Proposed Change 1: Extension to the Urban Air Quality Management Area, Penihana North, Waitakere

Proposed Change 1- Extension to the Urban Air Quality Management Area, Penihana North (the regional plan change) involves a change to the Auckland Council Regional Plan: Air, Land and Water (2010) (ALW Plan), which is operative in part.

Proposed Change 1 was accepted by the former Auckland Regional Council (ARC) in September 2010 and was publicly notified on 23 October 2010.  Hearings on Proposed Change 1 were held on 21 and 22 November 2011, with  planning commissioners appointed by Auckland Council. Decisions have not yet been released.

The Penihana North land is located on the southern side of the existing Waitakere City urban area adjacent to the suburb of Swanson.  It is approximately 22.5 hectares in size.  The northern boundary of the Penihana North land abuts the railway line. The eastern boundary is defined by O’Neills Road and the western boundary by Christian Road. The southern boundary is partly defined by the Blewitt Gully Stream, and the Penihana North land abuts land identified as Penihana South Land in the Waitakere District Plan.

The former ARC previously resolved to shift the MUL to include Penihana North land as a future urban area. This was done by consent order to resolve an appeal by Neil Construction against Proposed Change 6 to the ARPS (Neil Construction v Auckland Regional Council ENV-2007-AKL-00656). Change 6 became operative on 21 March 2012 and the Penihana North Land is now within the MUL. The MUL shift requires the Air Quality Management Area applying to the Pehihana North land to be changed from rural to urban.

Proposed Change 2: Extension to the Urban Air Quality Management Area, Mill Road, Manurewa

In September 2010, the former Manukau City Council accepted a private district plan change to rezone 47, 57 and 71 Mill Road Manurewa from a Rural 3 zone to the Main Residential zone. The land is a 5.1 hectare block of land immediately adjacent to a new residential subdivision called “The Gardens”. The rezoning will create a further 42 house sites and is notated as Private Plan Change 38 to the Manukau Operative District Plan 2002.

The subject land is currently within Rural Air Quality Management Areas under the ALW Plan. As this rezoning creates a new area of urban land, a change is also required to the Auckland Council Regional Policy Statement to extend the MUL (Proposed Change 18), and to the ALW Plan to incorporate the land within the Urban Air Quality Management Area (Proposed Change 2).

Hearings on Proposed Change 2 were held on 7 March 2012.
